Terms of service

Order Confirmation and Contract Acknowledgement
During the checkout process, you will be required to provide your email address and delivery details. Once the checkout is complete and payment is processed, we will send you an order confirmation and invoice. Please note that this correspondence does not constitute a contract between Perfect Bed and the customer.

Payment and Acceptance of Order
Before we can accept your order, full payment of the goods or acceptance for finance must be received. If you choose to pay on finance, you must have been approved for finance, paid the deposit, and signed the finance agreement. Your payment represents an offer to purchase the goods, and the contract becomes legally binding only when the goods are dispatched.

Ownership of Rights
All rights, including copyright, for this website are owned by or licensed to  Perfect Bed. Any use of the website or its contents, including copying or storing it (in whole or in part) for personal, non-commercial use, is strictly prohibited without our permission. You are not allowed to modify, distribute, or repost any material from this website without proper authorization.  Perfect Bed retains ownership of all materials and information contained on this website. You are granted a limited license only to view and order the materials on this website.

Delivery Charges
We offer free delivery within England, Wales, and Scotland (excluding certain postcodes listed in our delivery terms). However, if you are located in the Scottish Highlands or one of the postcodes excluded from free delivery, our couriers will apply a nominal fee for this service.

Delivery Process

11.1 Shipping Charges:
Our delivery charges are outlined in the shipping policy section of our website.

These charges are typically added to your order during the checkout process after entering your postal code. However, if the charge is not displayed during checkout but is listed in our exclusion from free delivery list, we will contact you after the order is placed to obtain permission to debit the charge from your card.

11.2 Delivery Restrictions:
Please note that we only offer delivery to addresses within the United Kingdom, excluding Northern Ireland. We are unable to deliver to Ireland.

11.3 Delivery Address and Instructions:
We will deliver the goods to the address specified in your order. It is important that this address is accurate. If you have any specific delivery instructions, please inform us via email at sales@perfectbed.co.uk. Once the goods have been delivered in accordance with your instructions, we cannot accept liability for any loss or damage to the goods, unless such loss or damage is caused by our negligence. In the event that you are notified of a delivery time slot and fail to answer your phone, resulting in a failed delivery, a minimum charge of £60 will apply for redelivery.

11.4 Delivery Times:
We strive to deliver the goods by the quoted delivery date indicated on each individual product page. However, please note that delivery times are not guaranteed. If we are unable to deliver within the specified time, we will contact you via email or telephone to provide a revised delivery time. You will then have the option to proceed with the order or cancel it. We will not be liable for any direct, indirect, or consequential loss, cost, damages, charges, or expenses arising directly or indirectly from any delay in the delivery of the goods.

11.5 Multiple Item Orders:
If you place an order for multiple items, we will deliver them together as soon as they are all available.

11.6 Ownership and Risk:
You will become the owner of the goods upon delivery. Once the goods have been delivered, they are held at your own risk, and we will not be liable for any loss or destruction.

11.7 Failed Delivery/Cancellation Charges:
Please note that if a delivery/collection date has been confirmed with the courier and you are not present, Perfect Bed reserves the right to charge a minimum of £40 to cover the cost of the failed delivery/collection. This charge also applies if a confirmed delivery is canceled or changed within 48 hours of the scheduled delivery date.

11.8 Inaccessible Delivery Locations:
If the delivery drivers are unable to bring the item upstairs due to size restrictions or safety concerns, you will have the option to accept the delivery as is, make your own arrangements to move the goods, or reject the delivery. If the delivery is rejected, a minimum charge of £70 will apply.

11.9 Liability for Damage:
Neither  Perfect Bed nor our contracted personnel will accept liability for any damage to the delivered product or your property (including fixtures, fittings, and building structures) while assisting with the delivery to the room of your choice. The customer assumes sole responsibility for this action, and any resulting damage should be covered by the customer's household insurance.

11.10 Upgraded Delivery Charges:
All upgraded delivery charges must be arranged and paid in full prior to delivery. These charges are non-refundable once the item has been dispatched with the courier.

11.11 Assembly of Flat Pack Beds:
Please note that Sarto Beds contracted deliveries do not include the assembly of beds. Most beds are flat pack and require assembly by the customer.

11.12 Delivery Time Slots:
Please note that delivery time slots provided are intended as guidelines only. While the courier company makes every effort to adhere to these time slots, factors such as traffic, breakdowns, and unforeseen circumstances may result in deliveries arriving outside the allocated time slot. We do not provide compensation for deliveries that fall outside the designated delivery time slot. Additionally, the courier may contact you 30 to 60 minutes prior to arrival if you need to be present to receive the delivery.

11.13 Flooring Protection:
For health and safety reasons, our delivery drivers are unable to remove their shoes when delivering products into customers' houses. If you need to protect your flooring, we kindly ask that you place an adequate cover on the floor prior to the delivery driver's arrival.

11.14 Removal of Old Beds or Mattresses:
We would like to clarify that we do not accept any blame or liability for customers who choose to remove or dispose of their old beds or mattresses prior to delivery. We strongly advise customers to dispose of old goods only after accepting the delivery of their new goods.

11.15 Cancellation Fee:
Once the items have been dispatched, a minimum cancellation fee of £70.00 applies if you wish to cancel or change your order.

Please note that if the item you have ordered is not listed on our website, we are unable to accept it for return.

11.16 Delivery to Room of Choice:
Please be aware that the courier company will deliver the products to the ground floor or a room of choice on the 1st or 2nd floor. If there is no lift and the delivery address is above the second floor, the courier will not be able to deliver to that floor.

11.17 Early Delivery:
 Perfect Bed reserves the right to deliver the products in advance of the quoted delivery date, provided that this has been communicated to the buyer beforehand.

11.18 Deliveries by National Carriers:
Deliveries made by national carriers will be conducted by one person and will be delivered to your front door.

11.19 Signature Required:
For security reasons, all goods must be signed for upon delivery. We are unable to deliver to unattended premises or outside of customer addresses.

11.20 Delivery to Doorstep:
 Perfect Bed provides delivery services up to your doorstep or just inside your front door. If you reside in a block of flats, delivery will be made to the ground floor only.

11.21 Special Delivery Requests:
If  Perfect Bed agrees to accommodate a special delivery request, no additional charges will apply. However, it is expected that the passageway and the designated room(s) are cleared in order to facilitate the delivery of the order.

11.22 No Assembly Service Provided:
Please note that  Perfect Bed and its third-party contractors do not provide assembly services for orders, even if requested. The responsibility for assembly lies with the customer. As a precautionary measure, customers are advised to have protective sheets available when accepting goods, as the delivered items may have passed through multiple warehouses and delivery vehicles.  Perfect Bed cannot be held liable for any damage caused during the delivery process.

11.23 Inspection Before Signing:
Prior to signing for the goods, we strongly recommend checking the boxes for any signs of damage. This allows you to identify and report any issues at the time of delivery.


Ownership and Risk
12.1 You become the owner of the goods upon their successful delivery. After delivery, the goods are at your own risk, and we cannot be held liable for any loss or destruction.

Delivery Cancellation and Returns
13.1 Under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 SI 2013/3134, you have the legal right to cancel your order within 14 calendar days after receiving the goods. If the item has not yet been dispatched, there will be no charge for canceling your order. However, if the item has already been dispatched or delivered, a minimum charge of £70 will apply for cancellations or returns.

To exercise your cancellation rights, please send an email to sales@perfectbed.co.uk with your name, order number, and a clear statement expressing your intent to cancel. If you have already received the items, please email your cancellation request to sales@perfectbed.co.uk

13.3 If you cancel your contract and have received the goods, you must retain possession of the goods and take good care of them until we arrange their collection.

Upon receiving your cancellation notice and either receiving the returned goods or evidence of their dispatch, we will refund the amount debited from your credit or debit card within 14 calendar days.

If the returned goods show a loss in value due to inadequate packaging for return collection, we may deduct a sum from your refund. The goods must be returned in their original packaging. Mattresses should not be used, and bed frames should not be partially or fully assembled when returning or canceling the order.

Accuracy of Content
We take great care in ensuring the accuracy of the content on our website, including correct pricing and accurate descriptions of goods. However, orders will be processed only if there are no significant errors in the goods' description or pricing as advertised on the website. Any weights, dimensions, or capacities provided for the goods are approximate.

Damage to Computer Equipment
While we strive to ensure that our website is free from viruses or defects, we cannot guarantee that using this website or any linked websites will not cause damage to your computer. It is your responsibility to have the necessary equipment and safeguards in place. Except in cases of negligence on our part, we will not be liable for any loss or damage to computer equipment resulting from using this website.

Availability
All orders are subject to acceptance and availability. If the goods are unavailable, they will be marked as out of stock, or our customer service team will notify you of the lead time. You will then have the option to wait, accept an alternative, or cancel your order. If you have already made payment and the product cannot be supplied,  Perfect Bed will refund or re-credit your account within 30 days, as agreed upon between the buyer and the seller. Please note that  Perfect Bed is not obligated to offer compensation for any resulting disappointment.

Ordering Errors
You may correct any errors in your order before clicking "submit" during the ordering process. However, if you fail to notify us of an error at least 24 hours before the agreed delivery date, and the goods have already been dispatched with the courier, your refund will be subject to a return fee, which will be deducted from your refund.

Price
The prices for goods you order are as displayed on our website and are inclusive of VAT at the current rates. The prices are accurate at the time of entering the information.

Payment Terms
Making a purchase from us is simple. Just browse our website, select the items you wish to buy, and add them to your shopping cart. Once you have finished making your selection, click on "Checkout" or the shopping cart icon, and provide the necessary details to complete your order.

All items are charged to your card immediately after placing the order. If your item has a longer lead time, you will be notified via email. Please note that we do not accept credit card information via email or over the telephone for security purposes.

Cancellation by  Perfect Bed
14.1  Perfect Bed reserves the right to decline the processing of your order under the following circumstances:
14.1.1 Insufficient stock to fulfill the goods you have ordered.
14.1.2 Delivery is not available to your area.
14.1.3 One or more of the goods you ordered was listed at an incorrect price due to typographical errors or errors in pricing information received from our suppliers.

14.2 If we are unable to process your order for the above reasons, we will notify you by email and promptly refund any amount deducted from your credit/debit card. The refund will be provided within 14 days.

Resolution for Faulty Items
15.1 In the event that you receive a faulty item, please contact us within 7 days, allowing us to arrange a replacement or collection of the damaged item. To facilitate the resolution process, kindly email us the details of your customer service request at sales@perfectbed.co.uk.

To assess the fault, we may request photos of the item to be emailed to us at sales@perfectbed.co.uk.

15.2 We are obligated by law to supply goods that conform to the contract and align with the Consumer Rights Act 2015.

15.3 If you wish to exercise your legal rights to reject goods that do not comply with the Act, we will arrange for their collection at our expense.

Liability
16.1 Unless otherwise agreed, if you do not receive the goods within the specified delivery lead time and decide to cancel the order instead of rescheduling the delivery (in accordance with clause 11), a full refund will be provided. However, if your item has already been dispatched with the courier company, a minimum charge of £70 will apply for order cancellation.

16.2 We accept responsibility for losses that are a natural and foreseeable consequence of breaching these terms and conditions. We are not liable if our ability to fulfill obligations is hindered or delayed by actions or omissions on your part or events beyond our reasonable control.

16.3 Furthermore, we are not liable for any losses related to your business, including but not limited to lost data, lost profits, lost revenues, or business interruption.

16.4 It is your responsibility to comply with all applicable regulations and legislation, including obtaining any necessary customs, import, or other permits required for purchasing goods from our site. Some national laws may prohibit the importation or exportation of certain goods. We assume no liability in respect to the export or import of the goods you purchase.

16.5 Notwithstanding the above, nothing in these terms and conditions is intended to limit your rights as a consumer under applicable local law or other statutory rights that cannot be excluded. It also does not seek to exclude or limit our liability for any death or personal injury resulting from our negligence. As a consumer, you have certain rights, including legal rights (e.g., under the Act) relating to faulty and/or misdescribed goods.

Notices
17. Unless explicitly stated otherwise in these terms and conditions, all notices from you to us must be in writing and sent to our contact address.

Warranties
18.1  Perfect Bed warrants that the Products, at the time of delivery, will conform to their specifications and be free from defects in quality, material, workmanship, and condition for a period of 12 months from the date of order.

18.2  Perfect Bed shall not be liable for any breach of warranty as per clause 18.1, unless:

18.2.1 The Buyer promptly provides written notice upon discovering or should have discovered the defect.
18.2.2  Perfect Bed is given a reasonable opportunity to examine the Products in question after receiving notice of the defect from the Buyer.

18.3  Perfect Bed shall not be liable for a breach of the warranty as per clause 18.2 if:

18.3.1 The Buyer continues to use the Products after giving notice of the defect to  Perfect Bed.

18.3.2 The defect arises due to fair wear and tear, willful damage, negligence, misuse, abnormal working conditions, or failure to follow written instructions regarding the storage or use of the Products.

18.3.3 The Buyer alters or repairs the Products without  Perfect Bed written consent.

18.3.4 The Buyer has not paid the Contract price for the Products by the Payment date.

18.4 Subject to clause 18.2, if any Products do not conform to the warranty,  Perfect Bed will, within 30 days of examining the defective Products, at its option:

18.4.1 Repair or replace such Products (or the defective part) free of charge.

Changes to Legal Notices
We reserve the right to modify these terms and conditions periodically, and we recommend reviewing them regularly.

Invalidity
If any part of these terms and conditions is deemed unenforceable (including any provision in which we exclude our liability to you), it will not affect the enforce-ability of any other part of these conditions.

Privacy
By using our services, you acknowledge and agree to be bound by the terms of our privacy policy.
